My fiance entered the US on a work permit which has expired. What are the risks in the marriage/gcard process?

We've had to live in separate states due to his lack of work permit, but are getting married and moving in together. If he's denied, what happens then? Will they take action? What and when will it be? Should I do anything to protect myself?My fiance entered the US on a work permit which has expired. What are the risks in the marriage/gcard process?
Illegal status is forgiven to spauses of US citizens.He entered legally and this is a plus.


If you get married he shouldn't leave the US because then he's facing possible ban from entering the US again (possible - because it's not clear how long he stayed illegal - if more than half a year - then 3 year ban, if more than a year - 10 years ban).


You two just marry and file for adjustment of status. His illegal status will be forgiven and no procedures will be applied against him. But of course you should convince the immigration officer at your first interview for his green card that your marriage is bone fide and not false (with documents and anwering all the questions the officer could have for you).


He can travel outside the US when he will receive his first conditional Green Card.

your fiance entered legally that is a plus but since he has been illegally/leaving working it makes him get penalized and the marriage/gcard will take a lot longer than a non-offense one





he has to pay a penalty and if your out of luck and unprotected he might just get deported you won't get in trouble unless you are found doing something illegal such as just marrying for papers

He is now an illegal alien and must go back to his own country. You can, possibly, apply for a fiance visa to get him back here, but no guarantee. Yes, you could be in trouble for aiding and abetting a criminal should you decide to marry or live together.
the main thing you have to know is chances are, they will be asking you a lot of questions regarding your relationship and they're gonna find out how much you know about eachother. Once you are married, you file for 485 864 639 all at once. My husband and I filed for all three in December of 2007 and we just had our interview today for his GC and since it has been 2 years since our marriage, he is a LPR.
